Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Kairo mobile application (the "Service" or "App") operated by Richard Amare ("Developer", "us", "we", or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
1. License to Use
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to download and install the App on a mobile device that you own or control and to run such copy solely for your personal, non-commercial purposes.
2. App Functionality and Data
- Kairo is a habit tracking application
- You are responsible for all habit data you input
- Data is stored locally on your device and, if you enable iCloud, securely in your private iCloud account via Apple’s CloudKit service
- iCloud storage enables syncing your habit data across your Apple devices signed in to the same Apple ID
- No user registration or authentication is required beyond your Apple ID for iCloud syncing
- We do not access or store your personal habit data on our servers; iCloud data is managed and secured by Apple according to their privacy policy
- You are responsible for managing your device and iCloud data, including backups and deletions
3. User Responsibilities
You agree not to:
- Use the Service for any illegal or prohibited purpose
- Reverse engineer or decompile the App
- Create derivative works based on the App
- Redistribute or transfer the App to third parties
- Use the App in a way that could damage or impair it
4. Kairo Pro Subscriptions
Billing
- Pro features require a paid subscription
- Payments are processed through the App Store
- Subscriptions auto-renew unless disabled 24 hours before renewal
- Your account is charged within 24 hours before period end
Management
- Manage subscriptions through App Store settings
- No refunds except where required by law
- We reserve the right to change pricing with notice
5. Third-Party Services
The App uses:
- Apple iCloud (CloudKit) for optional cloud syncing and backup of your habit data
- RevenueCat for subscription management
- Sentry for crash reporting and diagnostics
We are not responsible for third-party services' practices. Please review their respective policies:
6. Intellectual Property
The Service and its content remain our exclusive property, protected by copyright and trademark laws. Our trademarks may not be used without consent.
7. Disclaimers
- The Service is provided "AS IS" and "AS AVAILABLE"
- No warranties of any kind are given
- We don't guarantee uninterrupted or error-free service
- Kairo is not medical or health advice
- Consult healthcare professionals for medical questions
8. Limitation of Liability
We are not liable for:
- Indirect or consequential damages
- Loss of data or profits
- Unauthorized access to your device
- Third-party conduct
Maximum liability is limited to your paid subscription amount in the last 12 months.
9. Indemnification
You agree to defend and hold us harmless from claims arising from:
- Your use of the Service
- Breach of these Terms
- Your violation of any rights
10. Termination
- We may terminate service without notice
- You may terminate by deleting the App
- Relevant terms survive termination
11. Changes to Terms
We may modify these Terms at any time. Material changes will be notified through the App or App Store. Continued use means acceptance of new terms.
12. Governing Law
These Terms are governed by California law, without regard to conflicts of law provisions.
13. Apple App Store Terms
- Apple and subsidiaries are third-party beneficiaries
- You must comply with App Store Terms of Service
- Your use must comply with wireless data service terms
